Objection! *poses dramatically*
First, I would like to point out that by himself James /is/ a pile of man, which if the judge would allow, could be argued to be in fact a "man-pile"
Secondly, as the defendant has stated himself, he was "passed out". Being unconscious he would be in no position whatsoever to veryify whether or not it was, in fact, just him. *places hands on the bench, also dramatically*

OBJECTION! You cannot possibly take a drunken individuals account of the facts as ANY form of truth! The defendant himself has already stated that he was inebriated at the time of the incriminating photograph, therefore he is in NO condition to determine whether or not he was conscious or unconscious, furthermore if he was conscious then he would be able to recall such an incident as put forth by the photograph of the accused.
